The transactional work: acquiring the site, preparing and issuing off the plan contracts, managing disclosure, and settling lots once the plan registers. Development also involves matters outside conveyancing, such as joint venture and development agreements, planning appeals and finance documents, which are legal work for a lawyer rather than a conveyancer.
More than a standard contract. Alongside the usual disclosure, a residential off the plan contract with a sunset clause must carry a prescribed statement setting out that the vendor must give notice before rescinding, that the purchaser may refuse consent, and that the vendor otherwise needs a Supreme Court order.
It comes into existence on registration. Where a plan of subdivision creates common property, an owners corporation is created when the plan registers, and the initial rules, insurance and records need to be in place. Purchasers are entitled to disclosure about it before they sign.
In batches, once the plan registers. Registration triggers the settlement obligations for every lot at once, so notices go out together and settlements are scheduled across a short window. That concentration is why lender readiness and purchaser finance are checked well before registration.
That is a tax question rather than a conveyancing one. The margin scheme can change how GST is calculated on the sale of new lots, but eligibility depends on how and when the land was acquired. It needs settling with your accountant before contracts issue, since it affects the contract terms.
Usually more than a standard purchase. Site acquisitions often use option agreements or extended due diligence periods so the developer can test planning feasibility before committing. The contract terms are shaped around that timing, and the due diligence itself draws on planning and other advice beyond the conveyancing.
